The new rules of the 2023 Social EPA

Early retirement at 63 with APE SOCIALE for some categories of workers will also be extended for this year, as established by the 2023 stability law.

The anticipations for the financial maneuver for 2024 indicate an almost certain extension of this measure, since the planned overall pension reform cannot yet be implemented.

Ministry technicians are also considering the idea of setting up an APE Donna, reserved for female workers, which, unlike the Women’s Option, will not calculate the pension based on the contribution system, but will provide a fixed subsidy from the age
of 62 until the time of retirement.

Below we provide the requirements and instructions that are currently in effect.

The APE pension advance offers a bridging allowance starting from 63 and up to the retirement age, aimed at the most disadvantaged categories of workers, such as the unemployed, workers in strenuous tasks, the disabled and caregivers. This benefit is fully funded by the INPS and is provided up to the retirement age, with a maximum amount of
1500 euros per month.

The recent changes to the requirements for accessing the Social Bee were specified by the INPS in circular no. 62 of 25 May 2022. Among the news, it is important to highlight the cumulative rules with other income support, various unemployment requirements and the Ateco codes that allow construction workers to benefit from a reduction in the contribution requirement
.

The Social Bee was established on an experimental basis in 2017 and subsequently extended several times, until 2023, thanks to Law 197 of 2022.

To submit the application for Ape Sociale, it is first necessary to obtain the certification of the requirements, for which a platform was opened in January. The application forms for verifying the requirements and for accessing the benefit can be found on the website www.inps.it, following the path “Benefits and Services” > “Benefits” > “Social Ape – Pension Advance” > “Access the service”.

In addition, for heavy workers who wish to benefit from the Social Bee, new certificate templates are available on the site, in the “Services and Services” > “Forms” section. These models include the AP148, entitled “Employer attestation for the request for the Social Bee in relation to the work activities referred to in annex 3 of the law of 30 December 2021, n. 234”, and the AP149, called “Domestic Employer Certificate for the request for the Social Bee in relation to the work activities referred to in Annex 3 of the law of
30 December 2021, n. 234”.

The official communication specifies that those who have accumulated the necessary requirements in previous years without applying have the opportunity to resubmit their application, but must meet the new established requirements.

It is important to emphasize that those who obtain certification in 2023 will have the right to submit their application even later.

The deadlines for submitting applications for recognition of access requirements are as follows:

— March 31, with a response by June 30;
— July 15, with a response by October 15;
— November 30, with a response by December 31.

It is highly recommended to submit applications for certification of the right and for access to the APE at the same time if you already meet the requirements, so as not to lose monthly rent. Please note that the APE starts from the request for the check and not from the certification

Unemployed people who have just finished using NASPI or DISCOLL without respecting the three-month window, effective until 2021, can access the social APE starting from 1 January 2022.

The following are also allowed:

— workers dismissed during and after the probationary period or following the cessation of business activity;
— the unemployed with partial work activity (incapacitated), whose verification will be carried out by the INPS in collaboration with
the employment centers.

As for workers with heavy activities, it is necessary to refer to the new list provided with Annex 3 of the 2022 Budget Law, which replaces Annex A of DI 5.2.2018.

For the reduced requirement of 32 years, the INPS states that the following are allowed:

— construction workers with a national collective employment agreement for employees of construction and related companies, with ISTAT codes in annex 3;
— potters with ISTAT classification code 6.3.2.1.2;
— the drivers of plants for the forming of ceramic and terracotta articles with the ISTAT classification code 7.1.3.3

The interested party must have carried out, for at least six years in the last seven years or for at least seven years in the last ten years, one or more of the activities indicated in the list.

For working mothers belonging to the categories mentioned above, it is possible to benefit from a reduction in the contribution requirement of twelve months for each child, up to a maximum of twenty-four months. This reduction applies to thirty-two years of contributory seniority.

To apply for certification, the following documents are required:

— A letter of dismissal or resignation for just cause, or a consensual resolution report.
— A statement by the employer/employers on a model provided by the INPS, in which the periods of work performed, the collective agreement applied, the tasks performed and the level of classification assigned are indicated.
— In the case of construction, construction workers can submit a declaration signed by the managers of the Building Funds, in which the periods of registration with the Funds are specified

It is important to keep in mind that the Social Bee is compatible with citizenship income, but not with emergency income. Furthermore, it is not compatible with ISCRO and the extraordinary income and operational continuity allowance of freelancers enrolled in the separate management of INPS. If these last benefits have already been provided, the INPS reserves the right to recover
them.

Finally, the INPS specifies that from 2022 to 2024, social bee allowances will be paid up to 67 years of age, which corresponds to the age of access to an old age pension.
