Income limits for civil disability

The income limits for civil disability represent the ceilings within which you are entitled to receive civil disability benefits and social benefits. The INPS, in circular no. 1 of January 2, 2024, clarified that these benefits are directly linked to income. They are paid only if the beneficiary proves that they have an income lower than the limit established
by law.

Civil disability income limits 2024

According to circular no. 1 of January 2, 2024, the amounts for 2024, valid from January 1, of pensions and benefits intended for disabled civilians have been adjusted based on the trend in the cost of living. The income limits for the right to pensions for mutilated, disabled total civilians, blind civilians and deaf and dumb have increased
by 8.6% compared to 2023.

Here are the details:

  • Absolute civilian blind: 360.48 euro check, income limit 19,461.12 euros. If hospitalized, a check of 333.33 euros, same income limit. For partially blind civilians, check for 360.48 euros, income limit 19,461.12 euros

  • Total disabled civilians: check of 333.33 euros, income limit 19,461.12 euros.
  • Deaf and dumb: check of 333.33 euros, income limit 19,461.12 euros.
  • Partially disabled civilians: check of 333.33 euros, income limit 5,725.46 euros.
  • Monthly allowance for the attendance of disabled minors: check of 333.33 euros, income limit 5,725.46 euros.
  • Accompaniment allowance for absolute blind civilians: check of 978.50 euros, no income limit. For total disabled civilians and minors, a check of 531.76 euros, no income limit. Communication allowance for deaf and dumb, 263.19 euro check, no income limit. Special allowance for blind people in their twenties, check of 221.20 euros per month,
  • no income limit.

  • Workers with sickle cell disease or thalassemia major: 598.61 euro check, no income limit.

Obligations of the beneficiaries

To ensure verification and compliance with income limits for civil disability and social benefits, the law requires beneficiaries to report their income situation to the INPS. This is established by Article 35, paragraph 10-bis, of Decree-Law No. 207 of 30 December 2008, converted into Law No. 14 of 27 February 2009.

Services with mandatory communication

The reporting obligations apply to the following services:

  • Disability pension, referred to in article 12 of the law of 30 March 1971, n. 118.
  • Monthly care allowance, referred to in Article 13 of Law No. 118 of 1971.
  • Pension for the blind civilians, referred to in the law of 27 May 1970, n. 382.
  • Social security, referred to in article 3, paragraph 6, of the law of 8 August 1995, n. 335 and in article 19 of law n. 118 of 1971.
  • Pension for the deaf, referred to in article 1 of the law of 26 May 1970, n. 381.

How to communicate income and civil disability limits

To report income, it is necessary to submit your annual income statement to the INPS when applying. In the event of a no-show, there is a risk of stopping the income-related care provision. All notifications of notice, suspension and subsequent revocation of civil disability benefits and social benefits will be made by registered letter with acknowledgment of receipt by the INPS. The interested party may make the necessary income reconstitution
:

  • Directly online, by accessing the MyINPS personal area of the INPS site with SPID level 2, CNS or CIE. Follow the ‘Home’ path > ‘Benefits and Services’ > ‘Services’ > ‘Application for Pension Benefits’ > ‘Pension Benefit Change’ > ‘Reconstitutions/Supplements’ > ‘Pension Reconstitution’ > ‘Income’ > ‘For suspension of art. 35 paragraph 10 bis of Legislative Decree 207/2008’
  • .

  • Through Patronage Institutions or other entities authorized to mediate with the Institute.

What happens to those who do not respect their obligations

As specified by the INPS in message No. 3350 of September 12, 2022 (also valid in 2024), individuals who fail to comply with their income reporting obligations receive a reminder from the Institute. If they do not respond, interested parties receive from the INPS by registered letter:

  • Suspension of care provision.
  • Subsequent revocation of civil disability benefits and social benefits.

When does the INPS revoke the disability pension

The INPS revokes the disability pension if the interested party does not respond to changes in his income situation, as requested by the Institute following checks and checks. The revocation takes place in the following cases:

  • Exceeding the established age, i.e. 67 years.
  • Exceeding the allowed income limit.
  • Carrying out a work activity that generates a profit greater than the permitted income.
  • In the case of an assessment visit, if the INPS commission certifies that the minimum requirement required to obtain the benefit is no longer met.

Increase per million

Disabled civilians, blind civilians and deaf and dumb people under sixty-five are entitled to an increase of 10.33 euros per month as long as they do not exceed the following income limits:

  • 7,081.62 euros (retired only).
  • 14,863.55 euros (married retiree).

The decision of the Constitutional Court n. 152 of 23 June 2020 ordered a further increase called an “increase per million” equal to 417.71 euros for total disabled, deaf and blind civilians:

  • Unmarried beneficiary: own income not exceeding 9,555.65 euros.
  • Married beneficiary: own income not exceeding 9,555.65 euros and cumulative income with the spouse not exceeding 16,502.98 euros.
